Terms Of Service

Its a requirement that clients who're applying for a commission from me, must read and accept all of these terms and conditions. Please, read through the policy thoroughly, as a violation of these terms will result in the cancellation of your commission and blacklisting from future sales. These terms are always subject to change, at any time, without notice.

Commissioner permitted obligations:

These Terms of Service are relevant to the Artists' Allowed process through the projects and are subject to revisions, editing, and additions without notice.

  • The artist ( Me ) has the right to decline or reject a commission for any reason, especially if it goes against the terms.

 

  • I retain all rights to my work, which include but are not limited to; the right to use the artwork for self-promotion and upload it to any of my personal galleries or portfolio unless otherwise agreed upon. I can do private, time-sensitive gift commissions as well, so if you don't want me to upload the finished work to any of my galleries, please let me know beforehand.

 

  • You may NOT use the artwork for commercial purposes unless otherwise agreed upon.

    • i.e, any work that has gone against the T.O.S and the copyright law, will be blacklisted and dealt with accordingly.

    • Additionally, you may NOT use the artwork for any sort of NFTs/Blockchain/cryptocurrency etc.

Non-Commercial usage:

These Terms of Service are relevant to NONCOMMERCIAL projects only and are subject to revisions, editing, and additions without notice.

  •  Displayed base prices are subject to change according to the complexity, difficulty, size, and medium of each individual piece.

 

  • Clear and concise visual references and/or descriptions of a commission idea must be provided by the Client. After which a preliminary quote will be provided by the Artist. If no references are given, there will be additional costs for designing a character. Additionally, a form is preferable in this manner;

    • references and/or detailed descriptions of the character(s).

    • what you want the character(s) to be doing.

    • The overall mood of the image.

    • If ordering an image with a painted background, let me know if you want a specific environment, time of day, or what the weather will be like in the picture.

    • Your email address for the invoice.

 

  • Payments must be made in full within a week ( 7 days )  of receiving the invoice before any work is done. Payment plans are available for putting down 50% of the deposit on payments depending on the customer's circumstances. Once the full or down payment is processed, the Client‘s commission will begin upon receipt of the deposit.

 

  • Payments are accepted in USD only, through permitted payment methods or banking. The artist will not accept payment in any other form. Once the accepted payment is chosen, there may be a fee added which the customer will also have to pay depending on their services.

 

  • Clients will have the opportunity to direct alterations of the work during the sketch/thumbnail stage, and again at the flat color stage. Requested revisions that diverge from the Client‘s original commission description/references may increase the length of time a commission takes and will be billed separately. Revisions can´t be made after the commission is complete.

 

  • The client is allowed to ask for a Work-in-progress at any given time. Depending on the commission type, a clean-up sketch can be shown before approval and final payment.

 

  • Critiques and redline corrections for commissions are welcomed to ensure the best result. However, once the piece is in the line-art or painting stage, any alterations will have to be charged accordingly.

 

  • Large pieces may take up a month or more for your commission to be ready. Smaller commissions usually take less time and may get finished first than big commissions. Be mindful that I have a queue list.

 

  • If the client has a time-sensitive large piece that requires to be done early in advance then usually a month or more round time, will be charged a fee

  • Refund policy is as follows; 

    • If the client wishes to cancel their commission before work begins, the artist will retain 10% of the original commission payment in *USD* as a convenience fee.

    •  In the event of Client cancellation during the sketch/thumbnail stage phase, a 50% refund of the original payment will be issued. 

    • No refund will be issued if the Client cancels after the sketch stage.

    •  If the Artist cancels the commission, 100% of the original commission payment in the designated currency will be refunded to the Client.

 

  • Once the image is completed, the customer will have a full resolution file and a smaller, cropped version without the signature of your image via Google Drive or Deviantart stash and upload the final image to my gallery.

 

  • If the client plans to have it as a print, please inform the artist beforehand of the print dimensions so they will send out the CMYK version PSD file. Due to the print colors not registered the same as digital colors, I cannot guarantee the accuracy of the colors in the piece. The artist also cannot print the commission for you, since they don’t have the means to.

Commercial usage:

Additional Terms of Service for COMMERCIAL projects. Notice that every project may vary in its details, the shown terms are the set up basic terms.

  • On commercial commissions, you pay the same as on non-commercial. For wanting to use your commission commercial, you will have to buy a license which will depend on the size of the project, the planned usage, and range (private person, local business, or worldwide trader).

 

  • As established in  [ USA laws ]  the Artist retains the right to display all commissioned work on any personal website, this also includes commercial works. A delay can be planned in advance. If the commissioner publishes the commission, the artist will do so too.

 

  • By purchasing a license, you only buy one license (except clarified differently beforehand). If you plan to sell a license to different partners, the Client will have to buy different licenses from the artist. This can also be done after the project has long been done.

 

  • The Artist of course is the creator of the commission. Buying a license won't change that fact and the Client is engaged to mention the original Artist any time it's asked for (i.e. a customer requests the artist behind a merchandise’s design the Client sells the artist's commissioned design).

 

  • By buying a license, Copyright law drops off and the Artist will not reuse the work for prints, merchandise, etc. however the Artist can show their work on any personal platform, of course, watermarked and in low resolution.
